GENERAL SALES CONDITIONS

The present General Terms and Conditions of Sale (GTCS) apply, without restriction or reserve, to all sales concluded by LA PHOCEENNE DE COSMETIQUE with non-professional buyers wishing to acquire LOVEA cosmetic products on its Internet site www.lovea.fr.
These conditions apply to the exclusion of all other conditions, and notably those applicable to sales in stores or by means of other distribution and marketing circuits.
These general terms and conditions of sale are accessible at any time on this website and will prevail, if necessary, over any other version or any other contradictory document. In the absence of proof to the contrary, the data recorded by LA PHOCEENNE DE COSMETIQUE constitute the proof of all the transactions.
The modifications of these GTC are opposable to the users of the site from the moment they are put on line and cannot be applied to transactions concluded previously.
If one or more stipulations of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their scope.
Validation of the order by the purchaser implies unreserved acceptance of the General Terms and Conditions of Sale in their current version, which is expressly recognised by the purchaser, who waives, in particular, the right to take advantage of any contradictory document that may not be binding on LOVEA.

CHARACTERISTICS OF THE PRODUCTS OFFERED

The products offered are those that appear in the catalog published on the LOVEA site of the company LA PHOCEENNE DE COSMETIQUE. These products are offered within the limits of available stocks. LA PHOCEENNE DE COSMETIQUE reserves the right to modify the range of products at any time. Each product is accompanied by a description drawn up by LA PHOCEENNE DE COSMETIQUE and by a photograph that is as faithful as possible but cannot ensure a perfect similarity with the product presented, notably with regard to the colors.

PRICING

The prices appearing in the catalog are prices inclusive of tax in euros, taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products.
LA PHOCEENNE DE COSMETIQUE reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased. The delivery costs will be indicated before the validation of the order by the buyer.
In the case of a delivery outside metropolitan France, the customer or the person acknowledging receipt of the goods will have to pay immediately the possible customs duties. Indeed, the shipping costs do not include the customs fees and other additional costs that may be required at the entrance of certain countries, and these costs remain the exclusive responsibility of the customer. It is the customer's responsibility to check with the customs authorities that the products purchased are authorized to enter the country.

ORDERS

The buyer, who wishes to buy a product must

• Fill in the identification form on which he/she will indicate all the requested information;
• Fill in the online order form giving all the references of the products;
• Validate his order after having checked it and after reading the GTC;
• Make the payment in accordance with the conditions;
• Confirm the order and payment.

From the moment the customer confirms his order by clicking on the icon order*, he is considered to have accepted with full knowledge of the contents and conditions of the order and in particular the present conditions of sale, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the customer. *order with payment obligation.
The sale will be final at the time of confirmation of the order by the customer, without prejudice to the exercise by the customer of his right of withdrawal (whose terms are described below). This order will be confirmed by LA PHOCEENNE DE COSMETIQUE by the sending of an email to the client containing all the information previously delivered by LA PHOCEENNE DE COSMETIQUE, to which will be attached the retraction form and the general sales conditions.
A second e-mail will be sent to the client when the order is shipped.
LA PHOCEENNE DE COSMETIQUE recommends that the customer keeps these two emails. The client is informed that the two emails will be sent to the email address entered by the client at the time of identification, prior to the placing of the order. Also, in the event of an error in the entry of the electronic mail address concerned, or of non-receipt of the electronic message confirming the order, LA PHOCEENNE DE COSMETIQUE cannot be held responsible.
In Metropolitan France, the Buyer may also order by mail: by proceeding with his/her Internet order normally, then by printing his/her completed order with its references and by sending it in a stamped envelope at the current rate, to the following address:

METHODS OF PAYMENT

PAYMENTS by credit card:

LOVEA accepts payment by Visa and Marstercard. American Express cards are not accepted.
Payments made online by credit card will be made through a secure system that uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can gain knowledge of it during transport on the network.
Your security is a priority for us and that is why:
- The credit card number is entered on a secure page hosted by the bank, so it is not known to the LOVEA team
- The information is encrypted (SSL technology)
- The card number is never printed in full on the payment slips.

PAYMENTS via PayPal:

With PayPal the customer's financial information is never shared with LOVEA. PayPal encrypts and protects the customer's credit card number once and for all. The customer pays online by simply indicating his email address and password.

DELIVERY

The products acquired by the buyer will be delivered to the address indicated by the buyer when ordering on the website, within a maximum of 5 working days in metropolitan France and Corsica. Except in particular cases or unavailability of one or more products, the products ordered will be delivered at once.

The delivery is proposed to the buyer according to the tariff conditions of the Post Office in Colissimo service:

• At home: colissimo without signature 6,99 € for delivery in Metropolitan France and Corsicaoffered from 35 € of purchase.
• At a collection point: 4.99 € in Metropolitan France and Corsicaoffered from 35 € of purchase.

The delivery time by Colissimo is generally 48 hours, up to 5 working days (working days: Monday to Friday excluding holidays).

In the event of a specific request from the purchaser concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by LOVEA, the related costs will be the subject of specific additional invoicing, on the basis of an estimate previously accepted in writing by the purchaser.
Delivery shall be deemed to have taken place as soon as LOVEA has handed over the products ordered to the carrier. The transfer of ownership of LOVEA's products and the correlative transfer of the risks of loss and deterioration relating thereto shall be effected on acceptance of the order by LOVEA, materialising the agreement of the parties on the item and on the price, regardless of the date of payment and delivery. The products therefore travel at the risk of the purchaser who may, in the event of damage, make any claims to the carrier under the legal and regulatory conditions in force.
LOVEA undertakes to make every effort to deliver the products ordered within the time limits specified above. However, these deadlines are communicated as an indication and any overruns shall not give rise to any damages, withholding or cancellation of the order by the purchaser. However, if the products ordered have not been delivered within 30 days of the indicative delivery date, for any reason other than force majeure, the sale may be cancelled at the written request of the purchaser or LOVEA. The sums paid by the purchaser will then be returned to him/her without delay, to the exclusion of any compensation or deduction.

WITHDRAWAL AND RETURN PROCEDURES

In accordance with the provisions of article L 221-20 of the French Consumer Code, the buyer has a withdrawal period of 14 working days from the delivery of the products to return them to LOVEA for reimbursement.

In accordance with the provisions of article L 221-28 5°, products will only be reimbursed on condition that they have not been opened and are returned in their original packaging and in perfect condition. Used, damaged, soiled or incomplete items will not be accepted.

The return costs will be at the exclusive charge of the buyer.
It should be noted that any package not sent by LOVEA is not under its responsibility.
Only the sender of the package is able to launch an inquiry with the postal services.

To return the products, the buyer must

• Send an e-mail to manon@lovea.fr in order to obtain the withdrawal form and the certificate on the honor of not opening the products.
• Fill in and send back by email the transmitted forms.
• After acceptance by Lovea, the return of the items must be accompanied by a copy of the order form.
• As soon as the agreement is received, the customer has 14 days to return the product(s) to : LA PHOCEENNE DE COSMETIQUE - Chemin des Etamières - 78680 EPÔNE.

After this period, the return will be refused.
It is advisable to make the return by colissimo with tracking.
Refunds will be made within 14 days of receipt by LOVEA of the items returned by the buyer, with the exception of the return costs.
Lovea reserves the right not to reimburse products that do not comply with the above-mentioned provisions.

WARRANTY

All products supplied by the seller are covered by the legal guarantee provided by articles 1641 and following of the Civil Code.
The buyer is required to check the condition of the products delivered. He has a period of 30 days from delivery to make any reservations or claims for non-conformity or apparent defect of the products delivered, with all the related documents.
All claims or requests for reimbursement must be made by post to the following address LA PHOCEENNE DE COSMETIQUE - Chemin des Etamières - 78680 EPÔNE, within a period of 30 days following delivery (the postmark being taken as proof).
LOVEA will replace, as soon as possible and at its own expense, any products delivered with apparent defects or lack of conformity that have been duly proven by the buyer. After this period and if these formalities have not been respected, the products shall be deemed to be in conformity and free of any apparent defect and no claim may be validly accepted by LOVEA.

RESPONSIBILITY

The seller, in the process of selling online, is only bound by an obligation of means; his responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems.
LA PHOCEENNE DE COSMETIQUE cannot be held responsible for the non-respect of the legislative or regulatory provisions in force in the country of delivery, LA PHOCEENNE DE COSMETIQUE being solely responsible for the respect of the French regulations in force, relative to the products. It is therefore up to the Client to verify beforehand and under his sole responsibility that the importation of the products and their consumption are authorized in the country of delivery. In any case, and whatever the possible reason for calling into question the responsibility of LA PHOCEENNE DE COSMETIQUE, this is limited to the price of the order.

INTELLECTUAL PROPERTY RIGHTS

The present site and all its elements (brand, drawings, logos, models, photos, etc.) are the exclusive property of LOVEA. Any total or partial reproduction is forbidden.

SETTLEMENT OF DISPUTES

For all disputes or litigation, the competent court will be that of Mantes la Jolie in France (78).
By express agreement between the parties, the present contract is governed by and subject to French law. It is written in French language. In the event that it is translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.
LA PHOCEENNE DE COSMETIQUE archives the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The computerized registers of LA PHOCEENNE DE COSMETIQUE will be considered by the parties as proof of the communications, orders, payments and transactions that have taken place between the buyer and the seller.

MODIFICATIONS TO THE GENERAL CONDITIONS OF SALE

Taking into account possible changes in regulations and the site, we reserve the possibility of modifying the present GTC at any time. The new GCS will be available on line on the site lepetitolivier.fr and will be applicable to the only sales carried out after the modification.
